While serving this sentence, as a convict in the Auburn State Prison, he killed a fellow convict; was indicted for murder in the first degree, and found guilty of manslaughter in the third degree. He was thereupon sentenced on the 16th day of May, 1874, from Cayuga county to an additional term of four years, to commence at the expiration of the term of his former sentence, to wit, the 6th day of June, 1877. His sentence is hereby commuted so as to expire on the 22d day of March, 1879 |
